Under the Trademarks Act, 1999, you can register any distinctive visual representation that identifies your goods or services. This includes brand names, logos, slogans/taglines, word marks, device marks, product shapes, packaging layouts, three-dimensional marks, and sound marks (audio logos).

The official e-filing fee per class, per mark is:

  • ₹4,500 for Individuals, DPIIT-recognized Startups, and MSME/Udyam-registered Small Enterprises.

  • ₹9,000 for Private Limited Companies, LLPs, Partnership Firms, and large corporate entities.

  • ™ Symbol: You can start using the ™ symbol immediately upon submitting your online Form TM-A application and receiving your official Application Filing Receipt. It signals that a trademark claim is pending.

  • ® Symbol: You can only use the ® symbol after your mark is formally approved, published in the Trademark Journal, and issued an official Trademark Registration Certificate. Using ® without a valid certificate is an offense under Indian trademark law.

If your application passes examination without objections under Section 9 or Section 11, and faces no third-party oppositions during its 4-month publication in the Trademark Journal, approval takes 6 to 12 months. If an objection or opposition arises, the timeline extends to 18-24 months due to formal response filings and hearings.

India follows the international NICE Classification (NCL) system consisting of 45 distinct classes:

  • Classes 1 to 34: Cover manufactured physical goods (e.g., Class 25 for apparel, Class 30 for food products).

  • Classes 35 to 45: Cover service-oriented businesses (e.g., Class 35 for e-commerce/retail services, Class 42 for IT/software services).

    Each selected class requires a separate government filing fee.

  • Section 9 (Absolute Grounds): Raised if the Examiner finds your mark lacks distinctiveness, is overly generic, or directly describes the quality/nature of the product (e.g., trying to register “Best Coffee” for a cafe).

  • Section 11 (Relative Grounds): Raised if the Examiner finds your mark is identical or phonetically/visually similar to an existing active mark in the same or related class.

A registered trademark is valid for 10 years from the original date of application filing. It can be renewed indefinitely every 10 years by filing Form TM-R along with the prescribed government renewal fee.
